Being charged with a DWI in New Jersey can be overwhelming, and retaining a lawyer to review, prepare and resolve your case is essential. Whatever the complexity of your DUI case, with the Law Offices of Bartholomew Baffuto, Esquire, you would be conscientiously guided and counseled.
First Offense DWI
A first-offense DWI is a serious matter but carries lighter penalties upon conviction than repeat offenses. Penalties include fines, sometimes license suspension, and attendance in an Intoxicated Driver Resource Center (IDRC) program.
Installation of an ignition interlock device (IID) is now mandatory. The statute authorizes up to thirty days in jail, but jail time on a first conviction is rarely imposed.
Second Offense DWI
Second-time offenders face increased penalties, including higher fines, a mandatory one to two-year license suspension, community service, and imprisonment for at least 48 hours (almost always venued at the IDRC).
A person convicted will also be required to install an ignition interlock device for the term ordered at sentencing. The statute authorizes up to ninety days in jail, but in most cases 48 hours in the IDRC is all that would be ordered.
Third Offense DWI
The harshest penalties apply to a third or subsequent offense. There is a fine of $1,000, an eight-year license suspension, and a mandatory term of 180 days in jail. After that, an ignition interlock device must be installed. Attorney Bartholomew Baffuto, DUI lawyer in NJ, stands ready to protect your rights!.
Driving Under the Influence of Drugs (DUI)
Driving Under the Influence of Marijuana
Marijuana-related DUIs are treated in New Jersey in the same way as alcohol-related cases. Legalization for medical or recreational use does not mean that drivers cannot be prosecuted for driving under the influence.
Driving Under the Influence of Heroin
Heroin-related DUIs are treated in New Jersey in the same way as alcohol-related cases and drivers could also expect to face a criminal drug prosecution. Drivers are prosecuted for driving under the influence.
Driving Under the Influence of Oxycontin
Oxycontin-related DUIs are treated in New Jersey in the same way as alcohol-related cases and drivers could also expect to face a criminal drug prosecution. Drivers are prosecuted for driving under the influence.
Refusal to Submit to a Breath Test
New Jersey’s implied consent law requires cooperation with breath testing upon lawful request. Refusal of breath testing is a separately defined offense carrying significant penalties. Those include license suspension, fines, and the requirement to use an ignition interlock device.
DWI & Criminal Charges
Proof of a DWI offense in the context of a criminal prosecution can sometimes be an element of proof of a crime.
Federal DWI
Federal laws govern a federal DWI on U.S. Government property. Penalties are defined in reference to State statutes but can also include federal probation.
Underage
New Jersey has zero tolerance for drivers under 21 using alcohol. Fines, license suspension, community service, and mandatory alcohol education classes can result from a BAC as low as 0.01%.
