DWI and Criminal Cases

Drivers convicted of driving while intoxicated (DWI) in New Jersey must have an ignition interlock device (IID) installed.

What is an Ignition Interlock Device?

An ignition interlock device (IID) is a breath tester installed in your vehicle that will not allow it to start unless the operator passes a breath alcohol test. It is meant to prevent drivers who have been convicted of DWI from driving while impaired.

If you are facing such charges, contact the Law Office of Bartholomew Baffuto. Compliance is tracked, and any tampering or bypassing of the device could result in severe penalties.

When Is an Ignition Interlock Device Required?

New Jersey’s updated 2019 DWI law requires that all DWI convictions include IID installation as a provision of the sentence.  A judge will order you to install an IID in your vehicle for a set period.

New Jersey’s refusal law requires an IID for individuals who refuse a breath test, and the IID becomes mandatory following the license suspension period. In these cases, judges have little discretion.

How Much Does an Ignition Interlock Device Cost?

There are different costs associated with an IID, but on average, you will pay between $70 and $150 for installation fees. The monthly maintenance fees are usually around $60 to $90.  Costs may vary or increase with inflation.

Noncompliance with the installation order can result in additional charges and extended penalties.

When Can I Get My Ignition Interlock Device Removed?

An IID will be removed only after you have completed the required period stipulated by the court at sentencing.

You cannot remove the device. A certified IID provider must do it, and you must meet all legal requirements first. Before the court approves removal, the reports of compliance, with no tampering or failed tests, will be reviewed.

The requirement may be extended if the IID period is not maintained in compliance with the terms of sentencing.

The Law Offices of Bartholomew Baffuto can help you understand your rights and obligations. Regaining driving privileges while maintaining road safety requires compliance with IID regulations.
